Essential Legal Summary

• Neutral Mere Conduit: WiFiPlusPlus is a peer-to-peer transmission tool. We do not store, host, inspect, index, or curate files transferred by users.
• Zero Server Copies: Transferred files stream directly in-memory between devices or over local private LAN sockets. Zero byte copies are preserved on our servers.
• User Responsibility: Senders and receivers bear 100% legal responsibility for the legality, licensing, and contents of the files they transmit.
• Prohibited Content: Transmitting pirated software/media, unlicensed copyrighted files, malware, or illegal contraband is strictly forbidden.

1. Acceptance of Terms

By downloading, installing, accessing, or using the WiFiPlusPlus mobile application, desktop application, or Web Connect portal (an official product of BytePlusPlus Technologies; collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service.

2. Nature of Service: Neutral & Ephemeral Transmission Conduit

WiFiPlusPlus is a decentralized communication and data transfer utility designed to enable direct hardware-to-hardware local Wi-Fi, SoftAP, and peer-to-peer (P2P) connections between devices owned or controlled by users.

Zero File Archiving & Indexing: WiFiPlusPlus does NOT operate a file hosting repository, public download index, torrent tracker, or cloud backup drive. All cloud-mediated connections act solely as an in-memory PassThrough stream relay without disk persistence. Once a session completes or expires, in-memory buffers are instantly purged and destroyed.

3. Intermediary Safe Harbor (Section 79 IT Act & DMCA § 512(a))

Under Section 79 of the Indian Information Technology Act, 2000 (and Information Technology Intermediary Guidelines and Digital Media Ethics Code Rules, 2021), 17 U.S.C. § 512(a) of the United States Digital Millennium Copyright Act (DMCA), and Article 12 of the EU Electronic Commerce Directive 2000/31/EC, WiFiPlusPlus operates strictly as an intermediary and mere conduit:

• The Service does not initiate transmissions; transmissions are solely initiated at the request of the user.
• The Service does not select or modify the recipient of the transmission.
• The Service does not select or modify the data contained within the transmission.
• The Service does not maintain any permanent cache or copy of transmitted content.

Accordingly, WiFiPlusPlus and its developers, contributors, and hosting providers assume zero liability for any third-party content transmitted across the Service.

4. Acceptable Use Policy & Prohibited Conduct

You agree to use WiFiPlusPlus exclusively for lawful personal, professional, or commercial purposes. You strictly agree NOT to use the Service to transmit, distribute, or facilitate the exchange of:

5. User Warranties & Ownership

By selecting and transmitting any file via WiFiPlusPlus, you represent and warrant that:

• You are the creator, copyright owner, or authorized licensee of the file and possess all necessary rights to transmit it to the intended recipient.
• Your transmission does not infringe upon any third party's copyright, trademark, patent, privacy, or publicity rights.
• You accept full, unconditional civil and criminal liability for any legal claims arising from the content transmitted through your device.

6. Grievance Officer & DMCA Copyright Inquiries

In compliance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the DMCA, WiFiPlusPlus maintains a dedicated Grievance and Abuse contact desk.

Because WiFiPlusPlus does not store user files on permanent disk, we cannot remove or delete files that have already transferred between private peer devices. However, upon receipt of a valid notice alleging ongoing infringement via an active room token or relay endpoint, we will immediately terminate the offending session and block the associated IP/relay socket.

7. Disclaimer of Warranties & Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS THE DEVELOPER'S LEGAL LIABILITY.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL WIFIPLUSPLUS, ITS CREATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, DEVICE DAMAGE, FILE CORRUPTION, INTERRUPTION OF SERVICE, OR LEGAL PENALTIES RESULTING FROM THE USE OR MISUSE OF THE SERVICE BY ANY USER.

8. Indemnification

You agree to defend, indemnify, and hold harmless WiFiPlusPlus and its developers against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) any claim that a file transmitted by you caused damage to a third party or violated their intellectual property rights.

9. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
